The Environmental Protection Agency has created a new National Pollutant Discharge Elimination System (NPDES) "general permit" for stormwater runoff from construction sites, according to a report in Bloomberg BNA (EPA Submits Permit for Construction Sites Minus Turbidity Limits for Stormwater Runoff, by Amena H. Saiyid). The new permit will not include numerical limits for "turbidity" — an issue that triggered a lawsuit by the Wisconsin Builders Association. EPA admitted in that lawsuit that the numerical turbidity limit was based on an erroneous calculation method. EPA says their new rule, minus the turbidity limit, will be ready by the time the current permit, adopted in 2008, expires on February 15th.
