Figuring out what constitutes a "water of the U.S." is complicated and often can’t be resolved without input from the U.S. Army Corps of Engineers (USACE). For example, if a project requires excavating sediment from a pond and the pond isn't a U.S. water, the project doesn't need a Section 404 permit. If a site is discharging fill to a ditch and that ditch also happens to be a U.S. water, you may be risking a cease-and-desist letter from USACE.

Altered ditches, ponds, and tributaries present the greatest challenge and face the greatest uncertainty as the definition is altered to fit the Trump administration’s policy vision. This one-hour webinar walks attendees through the seven parts of the federal definition using real-world examples. Additional tools are demonstrated that explain how to classify waters of the U.S. for any Clean Water Act program.
